Standard Turnaround: Commissions will take within' 1 week to 2 weeks to complete.

Rush Orders: Need your artwork faster? Rush orders can be accommodated for a 25% fee on the total commission. However, commissions with backgrounds are not available for rush orders.

Artist Credit: I kindly request that you credit me as the artist whenever you display the artwork.

Usage Rights: The artwork is for your personal enjoyment (unless we agreed on commercial rights and usage) and cannot be claimed as your own or uploaded to any AI platforms.

Free Revisions: I offer 3 rounds of revisions for the sketch phase and 3 minor revisions at finishing phase.

Additional Revisions: Any revisions requested beyond the included rounds will incur a $15 fee per revision.

Commissions are non-refundable upon the discretion of the artist. This applies to both commercial use, commission, personal use commissions, or commissions paid outside of PayPal Invoices and VGen.

I reserve the right to decline and refund commissions at my discretion.

International Clients: PayPal or VGen (fees apply on VGen.)

For a smooth workflow, full payment is kindly requested upfront before I begin work, unless previously agreed upon.

Payment plans are available for commissions exceeding $175. Please inquire for details.

Detailed Backgrounds: starts at a base price of $15 depending on complexity and detail.

Additional Info: Any commissions paid, regardless paid outside of PayPal Invoices and for commercial usage, will still carry the share the same weight as personal commissions in terms of payments and refund. Moreover, any commissioned artwork produced by MIGGYTHEO will fall under this terms of service.

By submitting payment for a commission, the client acknowledges and agrees to the Artist’s Terms of Service and Guidelines, which are provided with the commission details. This agreement applies to all commissioned artwork, whether for personal or commercial use, and includes all payment methods, such as PayPal and VGen. It remains in effect regardless of any external contracts, except for commercial commissions that are specifically invoiced by the artist via PayPal.

Prior to commencing work, the Artist will require contact information for the Client, including their name, email address, and any relevant social media user names. All contact information will be held securely by the Artist and used solely for contacting the Client about commissioned work: it will not be resold, exchanged, or otherwise divulged to third parties without additional, explicit consent from the Client. The Client accepts that all Client information held by the Artist will be held in compliance with the data protection regulations of the Philippines.

Prior to the artist beginning work on the art and character design, both the Client and the Artist have the right to withdraw from this agreement. Where a deposit for the work has already been paid in full or in part by the Client, any full or partial refund of the deposit will be at the sole discretion of the Artist (in compliance with the terms laid down in the section of this agreement titled "Payment and Fees").

In the event that the working relationship between Client and Artist irreparably breaks down, the Artist reserves the right to terminate this agreement. No refund of the deposit will be provided to the Client in this event. At the sole discretion of the Artist, usage and ownership rights of work completed prior to the breakdown in the working relationship may be transferred to the Client. Such transfers may be subject to appropriate compensation, at the sole discretion of the Artist, and any such compensation will be negotiated separately from this agreement as required.

100% of the fee will be paid to the Artist in advance of work commencing as a deposit for the work and will serve as a validation that the terms of service has been fully understood and agreed upon by the Client, regardless of where the Client paid and contacted the artist from.

At the sole discretion of the Artist, this deposit may be refunded in full in the event that work is unable to proceed due to no fault on the part of the Client. Where work is unable to proceed due to fault on the part of the Client, and also at the sole discretion of the Artist, up to 50% of the deposit may be refunded. In the event that a deposit is refunded, whether in part or in full, all currency conversion and transfer fees will be subtracted from the refunded sum. However, all refunds is still up to the discretion of the artist in any case threat, lack of cooperation, aggression, ghosting, and such is experienced by the artist no refund and notice shall be given.

The Artist will invoice the Client for the agreed amount once the scope, pricing, and other pertinent details of the work have been agreed upon has been completed by the Client. Work will not commence until after the invoice has been paid in full. The Client is responsible for paying all currency conversion and transfer fees imposed by the payment service that's included in the price advertised (i.e. Paypal fees).

During the development of the work, the Client accepts that a total of three major revisions will be provided by the Artist during the sketching phase and a total of three minor revisions will be provided by the Artist during the coloring and finishing phase. Any additional revisions requested by the Client at either stage will incur a further cost of $10 per additional revision.

If the Client fails to respond to the Artist’s follow-up within a month, the commission will be canceled without a refund. Additionally, the Artist reserves the right to cancel the commission without a refund if the Client fails to adhere to the Terms of Service, regardless of any external agreements.

If the Artist encounters negative behavior, unprofessionalism, or harassment from the Client, the commission may be canceled without refund, notice, or delivery of any work. Any work already completed will be reclaimed by the Artist, and the Client will forfeit all rights and ownership to it.

Upon completion of the work, receipt of the full payment due, and explicit acknowledgment by the artist that these criteria have been met, the Client will receive the following rights:

a) A single, non-transferable, non-commercial use licence for the artwork. This licence is subject to the following provisions:

The Client must give full credit to the Artist when displaying or otherwise utilising the artwork. (Linking my website and/or by stating my social media username: @miggytheo.)

The Client and their agents must not augment the work through the use of Artificial Intelligence.

The Client and their agents must not use the work as part of a training data set (individually or as part of a collective) for Artificial Intelligence.

In the event that any of these provisions are violated, the Artist may revoke this licence without compensation to the Client.

b) Full ownership and usage rights for any character design work undertaken as part of the work.

Full ownership and usage rights for the artwork, including the right to use the artwork in the Artist's portfolio and for personal promotion.

At the discretion of the Artist and by explicit agreement with the Client, the Artist may refrain from using the artwork in the Artist's portfolio and for personal promotion. However, any such decision by the Artist in no way relinquishes the Artist's full ownership and usage rights for the artwork.
